AGB

1. Scope

 

The following Terms and Conditions apply to all orders placed through our online shop by consumers and entrepreneurs.

Consumers are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and are therefore natural or legal persons who are not entrepreneurs.

With regard to entrepreneurs, the following applies: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

An entrepreneur is any person for whom the transaction forms part of the operation of their business. An enterprise is any organization established on a long-term basis for independent economic activity, regardless of whether it is profit-oriented. Legal entities under public law are always considered entrepreneurs.

 

2. Contract partner, conclusion of contract, correction options

 

The purchase contract is concluded with
Patrik Pondorfer – Commercial trade excluding regulated commercial trades.

By placing the products in the online shop, we submit a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.
The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

 

3. Contract language, storage of contract text

 

The language(s) available for concluding the contract: German, English

4. Delivery conditions

 

Delivery options
We ship the products to the delivery address specified during the ordering process.

Any extraordinary right of termination without notice for good cause remains unaffected. A good cause exists if, taking into account all circumstances of the individual case and weighing the interests of both parties, continuation of the contractual relationship until the agreed termination or expiry of a notice period cannot reasonably be expected of the terminating party.
The provisions of § 1162 ABGB remain unaffected.

Termination must be made in text form (e.g., letter, email).

We deliver exclusively by shipping. Self-collection of the goods is unfortunately not possible.

 

5. Payment

 

The following payment methods are generally available in our shop.

Credit card
During the ordering process, you enter your credit card details. Your card is charged immediately after the order is placed.

Google Pay
To pay the invoice amount via Google Pay, you must be registered with Google, have Google Pay activated, authenticate yourself using your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.

Electronic Payment Standard (EPS)
To pay the invoice amount via the payment service provider PSA Payment Services Austria GmbH, Handelskai 92, Gate 2, 1200 Vienna, Austria, in cooperation with Austrian banks (“Electronic Payment Standard (EPS)”), you must have an online banking–enabled bank account with an Austrian credit institution, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.

Apple Pay
To pay the invoice amount via Apple Pay, you must use the “Safari” browser, be registered with Apple, have Apple Pay activated, authenticate yourself using your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer the following payment options. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with the respective payment option and during the ordering process.

Purchase on account via Klarna
The invoice amount is due 30 days after shipment of the goods and receipt of the invoice. Payment by invoice is only available to consumers.

Klarna may offer additional payment options to registered Klarna customers selected according to its own criteria within the Klarna customer account. We have no influence on the availability of these options; any additional payment options offered are part of your legal relationship with Klarna. Further information can be found in your Klarna account.

Installment purchase via Klarna
You may pay the invoice amount in up to 36 monthly installments. For some orders, a down payment may be required. The due dates are determined by Klarna’s payment plan. Installment payments via Klarna are only available to consumers.

Klarna may offer additional payment options (e.g., interest-free installment plans) to selected registered Klarna customers within the Klarna account. We have no influence on the availability of these options; any additional payment options offered are part of your legal relationship with Klarna. Further information can be found in your Klarna account.

Sofort / Sofortüberweisung via Klarna
To pay the invoice amount via Sofort/Sofortüberweisung through Klarna, you must have a Klarna account and an online banking–enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. No credit check is carried out by Klarna when using Sofortüberweisung. Your account is debited immediately after placing the order. Further information is provided during the ordering process.

Mollie B.V.
Payment processing is carried out via the payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands. Mollie provides the technical processing of various payment methods, including credit card, Apple Pay, Google Pay, EPS, and Klarna payments (Sofort, invoice, installment purchase). When selecting one of these payment methods, payment processing is carried out via Mollie in accordance with the selected method. 6. Right of withdrawal

 

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of title

 

The product remains our property until full payment has been made.
For entrepreneurs, the following additionally applies: We retain ownership of the product until all claims arising from an ongoing business relationship have been fully settled. You may resell the reserved goods in the ordinary course of business; all claims arising from such resale are hereby assigned to us in advance in the amount of the invoice value, regardless of whether the reserved goods are combined or mixed with a new item, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect them ourselves if you fail to meet your payment obligations. Upon request, we will release the securities to which we are entitled to the extent that their realizable value exceeds the value of the outstanding claims by more than 10%.

 

8. Transport damage

 

For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to make a complaint or contact us has no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurer.

For entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have handed over the goods to the forwarding agent, carrier, or other person or institution designated to carry out the shipment.

 

9. Warranty and guarantees

 

Applicability of statutory liability for defects

Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and reductions in time limits do not apply to claims for damages caused by us, our legal representatives, or vicarious agents

– in the event of injury to life, body, or health
– in the event of intentional or grossly negligent breach of duty or fraudulent intent
– in the event of breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
– within the scope of a guarantee promise, if agreed, or
– insofar as the Product Liability Act applies.

Restrictions for entrepreneurs

For entrepreneurs, only our own statements and the manufacturer’s product descriptions included in the contract are deemed to constitute an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising claims.
For entrepreneurs, the limitation period for defect claims for newly manufactured goods is one year from the transfer of risk. The previous sentence does not apply to items that have been used for a building in accordance with their usual use and have caused its defectiveness. The sale of used goods is carried out with the exclusion of any warranty. The statutory limitation periods for recourse claims pursuant to § 933b ABGB remain unaffected.

Notice to merchants

For merchants, the obligation to inspect and give notice of defects regulated in § 377 UGB applies. If you fail to provide the notice stipulated therein, the goods shall be deemed approved, unless the defect was not recognizable during inspection. This does not apply if we have fraudulently concealed a defect.

Guarantees and customer service

Information on any applicable additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.

Our customer service is available to you for questions, complaints, and objections by email at Austrianspeptides@gmail.com. Inquiries are usually answered within 1–2 business days. Customer service is available Monday to Friday from 9:00 a.m. to 5:00 p.m. (excluding public holidays). Please note that only factually worded and complete inquiries will be processed. Messages containing offensive, unprofessional, or spam-like content will not be answered.

 

10. Liability

 

We shall always be liable without limitation for claims arising from damages caused by us, our legal representatives, or vicarious agents

– in the event of injury to life, body, or health,
– in the event of intentional or grossly negligent breach of duty,
– in the case of guarantee promises, if agreed, or
– insofar as the Product Liability Act applies.

In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, liability shall be limited in amount to the foreseeable damage at the time the contract was concluded, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

 

11. Dispute resolution

 

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

Additional clause to the Terms and Conditions (AGB)

 

Intended use and liability disclaimer for peptides
Our products (in particular peptides and research chemicals) are intended exclusively for laboratory, research, and analytical purposes. They are not suitable for human or animal consumption, medical use, or cosmetic purposes.
Any use contrary to this notice is expressly at the user’s own responsibility.

Product properties and storage
Peptides are sensitive laboratory products. They must be stored in a cool, dry place, protected from light and shock. Improper storage may impair stability or purity.

Transport damage and defect notification
If products appear externally damaged or leaking upon receipt, the buyer must inform us by email within 24 hours of delivery. After this period, complaints regarding transport damage can no longer be considered.

Age Verification

By placing an order on this website, the customer expressly confirms that they are at least 18 years of age.
The purchase of our products is strictly limited to adults only.
By completing a purchase, the customer further declares that all products are acquired solely for research and analytical purposes.

No Human or Animal Testing

The products offered on this website are not approved for human or animal use, including but not limited to medical, veterinary, cosmetic or dietary applications.
Any use involving living organisms is strictly prohibited.

No Customs / Seizure Liability

The seller is not responsible for delays, seizures, inspections or confiscations by customs authorities or regulatory bodies.
In such cases, no refunds or replacements will be issued.

No Resale / Redistribution

The resale, redistribution or transfer of purchased products to third parties for consumer, medical or commercial purposes is strictly prohibited, unless explicitly agreed upon in writing.

Limitation of Liability

To the maximum extent permitted by law, the seller shall not be liable for any direct, indirect, incidental, consequential or special damages arising from the purchase, possession or use of the products.

Product Information Disclaimer

All product descriptions, analytical data and documentation provided on this website are for informational purposes only and do not constitute instructions, recommendations or guarantees of suitability for any specific application.

Storage & Handling Responsibility

The customer is solely responsible for ensuring proper storage, handling, safety procedures and disposal of the products in accordance with applicable laboratory standards and regulations.

No Refunds After Shipment

Once an order has been shipped, it is considered final and non-refundable, except where mandatory consumer protection laws explicitly apply.

Force Majeure

The seller shall not be held liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, supply chain disruptions, regulatory changes or carrier issues.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

Acceptance of Terms

By accessing this website or placing an order, the customer confirms that they have read, understood and agreed to all Terms and Conditions in full.
